Mi opinión sobre la ley de bienestar animal española
My opinion on the Spanish animal welfare law

He dudado mucho si escribir este email. Pero allá va. Si después de esto te caigo mal, ya sabes que siempre tienes un botón para desuscribirte en la parte de abajo.
Mira, yo soy veterinaria (con un master en bienestar animal, para más señas). Pero además de corazón. ¿Sabes porqué estudié esa carrera? porque adoro a los animales, me encantan, me flipan, me sorprenden. Me gusta observarlos, tocarlos, entenderlo, cuidarlos, curarlos… todo.
Luego ya al ser mamá, descubrí que también me encantan l@s niñ@s. Hay algo puro, sin “contaminar” en sus cabecitas, que me vuelve loca. Y suelo tener mucho rollo con ell@s, se “me dan bien”.
Y l@s niñ@s y los animales tienen una atracción mutua maravillosa. Es muy raro el niñ@ que no le gusten los bichos. Este proyecto nació porque vi que existía un vínculo ahí muy bueno que abría un canal emocional que podía aprovecharse en el aprendizaje, para iniciar una relación buena, respetuosa y de entendimiento con los animales y por extensión con toda la naturaleza.
En España entra en vigor mañana una polémica ley sobre el bienestar animal. Para alguien amante de los animales, como yo estoy debería ser una buena noticia. Y en parte lo es, dice mucho de una sociedad el cómo se trata a los animales y en mis 48 años de vida, he visto una evolución en general a mejor en este sentido.
Pero esta ley tiene muchísimos puntos con escasa base científica y se ha hecho con muy poco consenso entre los agentes implicados. Desde mi punto de vista es una ley demasiado basada en una visión Disney de lo que es un animal. Y eso no es bueno ni para los animales ni para el medio ambiente.
Sin embargo, los lobys de presión se han movido como han querido. En España es legal matar un toro bravo por asfixia en público, previa tortura (que sin tapujos lo que le pasa a los toros de lidia cuando les meten la puntilla) mientras la gente aplaude. Y los perros de caza, que son realmente animales que sufren una barbaridad, han quedado fuera de esta protección.
Pero mira tú por donde tener un hamster en casa se va a ver muy en entredicho, si no entra en un “listado positivo” de animales que “se vale” tener. La incongruencia es enorme.
En el artículo 33.2 Fomento de la convivencia responsable con animales, dice así:
En el ámbito de la convivencia responsable, las instituciones educativas y de formación no realizarán prácticas contrarias a la misma, tales como el uso de las aulas como lugar de residencia de animales, la distribución de animales entre el alumnado y cualquier otra práctica similar.
¿Significa esto que no se puede tener un acuario en una escuela española?
Pues sinceramente no lo sé, porque esto está lleno de matices. El fin de un acuario tal y como yo lo propongo, sería la educación, no sería un animal de compañía, por lo que no tengo claro que aplique la ley. He hecho la consulta la ministerio directamente. Nadie me ha contestado.
¿Y porqué sigo hablando del proyecto del acuario en esta newsletter?
Bueno, pues primero porque creo de corazón que el valor educativo de un acuario es enorme. Como vengo hablando estos días es un pequeño ecosistema que puedes recrear en un espacio pequeño y entender cómo funciona. Y que es bueno para tod@s, niños, animales, maestros y medio ambiente.
En los 5 años que llevo montando acuarios en las escuelas siempre he visto que después de este proyecto l@s niños cuidaban y querían más a los animales que antes de hacerlo.
Y luego esta newsletter no solo la reciben profesores de España. La reciben 15.000 personas de todo el mundo, en concreto de 68 países.
Esto la convierte en una de las newsletters más potentes escritas en castellano, no ya del ámbito educativo sino en general. Lo sé porque tengo un proyecto paralelo (Moresubscribers) que funciona como un tiro y en el que enseño a emprendedores digitales a conseguir suscriptores.
Podría tranquilamente vivir de ese proyecto, y abandonar la educacion. Pero llámame romántica, tonta, ilusa o soñadora, pero cada vez que me veo tentada de ello me resuenan en la cabeza las palabras de Mandela:
La educación es el arma más poderosa que puedes usar para cambiar el mundo.
¿Y sabes lo que te digo? Que me da la gana intentarlo, que tengo buenas propuestas y quiero que lleguen a destino. Y poner mi granito de arena para tener un mundo mejor.

Look, I am a veterinarian (with a master's degree in animal welfare, by the way). Do you know why I studied that career? Because I love animals, I love them, they amaze me, they amaze me, they surprise me. I love watching them, touching them, understanding them, caring for them, curing them... everything.
Later, when I became a mum, I discovered that I also love children. There is something pure, uncontaminated in their little heads that drives me crazy. And I tend to have a lot of fun with them, they are "good for me".
And children and animals have a wonderful mutual attraction. It is very rare that a child doesn't like animals. This project was born because I saw that there was a very good bond there that opened an emotional channel that could be used in learning, to initiate a good, respectful and understanding relationship with animals and by extension with all of nature.
In Spain a controversial law on animal welfare comes into force tomorrow. For an animal lover, as I am, this should be good news. And in part it is, it says a lot about a society how animals are treated and in my 48 years of life, I have seen a general evolution for the better in this sense.
But this law has very many points with little scientific basis and has been made with very little consensus among the agents involved. From my point of view, it is a law that is too much based on a Disney vision of what an animal is. And that is not good either for the animals or for the environment.
However, the lobbies have moved as they wished. In Spain it is legal to kill a fighting bull by asphyxiation in public, after torture (which is what happens to fighting bulls when they are gored) while people applaud. And hunting dogs, which are really animals that suffer terribly, have been left out of this protection.
But look where having a hamster at home is going to be very questionable, if it does not enter in a "positive list" of animals that are "ok" to have. The incongruity is enormous.
In article 33.2 Promotion of responsible coexistence with animals, it reads as follows:
In the field of responsible coexistence, educational and training institutions shall not carry out practices contrary to it, such as the use of classrooms as a place for animals to live, the distribution of animals among the student body and any other similar practice.
Does this mean that you cannot have an aquarium in a Spanish school?
I honestly don't know, because this is full of nuances. The purpose of an aquarium, as I propose it, would be education, it would not be a pet, so it is not clear to me that the law applies. I have consulted the ministry directly. Nobody has answered me.
And why do I keep talking about the aquarium project in this newsletter?
Well, first of all because I believe in my heart that the educational value of an aquarium is enormous. As I have been talking about these days, it is a small ecosystem that you can recreate in a small space and understand how it works. And it is good for everyone, children, animals, teachers and the environment.
In the 5 years that I have been setting up aquariums in schools I have always seen that after this project the children cared for and loved the animals more than before.
And then this newsletter is not only received by teachers in Spain. It is received by 15,000 people from all over the world, specifically from 68 countries.
This makes it one of the most powerful newsletters written in Spanish, not only in the educational field but in general. I know this because I have a parallel project (Moresubscribers) that works like a charm and in which I teach digital entrepreneurs how to get subscribers.
I could easily make a living from this project, and abandon education. But call me romantic, foolish, deluded or a dreamer, but every time I am tempted to do so, Mandela's words ring in my head:
Education is the most powerful weapon you can use to change the world.
